NOTICE OF INITIATION OF AN INVESTIGATION INTO THE ALLEGED DUMPING OF POLYETHYLENE BATTERY SEPARATOR MATERIAL WITH A BACK-WEB THICKNESS OF 0.25mm EXPORTED FROM AND ORIGINATING IN THE UNITED STATES OF AMERICA The Board on Tariffs & Trade received a petition alleging that polyethylene battery separator material with a back-web thickness of 0.25mm, exported from and originating in the United States of America, is being dumped on the South African market, causing material injury to the South African industry concerned.

Petition
The petition was lodged by Zimco Industries (Pty) Limited trading as Zimtek Separators, the only manufacturer of polyethylene battery separator material in the Republic of South Africa. The petitioner alleges that it is unable to compete with the low prices of the imported product. The low prices are suppressing and depressing the prices of its domestic product, which in turn is impacting negatively upon the company's profitability. The petitioner submitted sufficient evidence in respect of dumping and material injury to justify the initiation of an investigation.

Product
The product under investigation is polyethylene battery separator material with a back-web thickness of 0,25mm, exported from and originating in the United States of America. The material is used to separate as well as form an envelope around the lead plates contained in any starting, lighting or ignition battery. The separator material is made of high molecular weight polyethylene and amorphous silica. The goods are classified under tariff subheading 6815.99.

Time limit
Any information and/or arguments regarding this matter and any request for informal discussions must be submitted in writing to reach the Chairman, Board on Tariffs & Trade, Private Bag X753, Pretoria, 0001, not later than 30 days following the publication of this notice.

If the required information and arguments are not received as prescribed within the time limit specified above, the Board may make preliminary or final findings on the basis of the facts at its disposal.

GENERAL NOTICE 1590 OF 1996
NOTICE OF PRELIMINARY DETERMINATION OF INVESTIGATION INTO THE ALLEGED DUMPING OF SODIUM HYDROXIDE (CAUSTIC SODA) ORIGINATING IN THE UNITED STATES OF MAERICA, SAUDI ARABIA AND IRAN The Board on Tariffs & Trade gave public notice of its investigation into the alleged dumping of sodium hydroxide (caustic soda) imported from or originating in theUnited States of America, Saudi Arabia and Iran in Notice 292 published in Government Gazette No.17028 of 15 March 1995.

The Board made a preliminary determination that, although dumping was occuring, the injury suffered by the local manufacturer due to the dumping could not at this stage be regarded as being of a material nature and that the investigation should therefore be terminated. The Board’s report containing the preliminary determination and the reasons therefor is available from the Board on request, and interested parties are invited to comment thereon within 30 days after the date of this publication.

The Board will make a final determination on the basis of the facts at its disposal after the time limit specified above.
