Another take on liability

I refer to the “metal into

bricks” (kind of water

into wine!) article ‘Scrap

metal turns into bricks

– but who is liable?’

(FTW October 9, 2015)

and wondered if any of

the commentators had

considered the possibility

that, with collusion

between the buyer and

the seller, scrap metal

was never intended to be

loaded into the container.

This would then raise

the question as to which

party cut the bill of

lading and who made the

false declaration?
