JOY ORLEK THE DEPARTMENT of Transport is tightening the screws on roadfreight operators who ignore the compliance requirements of the Road Traffic Act in relation to “operator fitness”. A recent audit of a large Gauteng haulier revealed non-compliance with the Act and a suspension of up to 12 months is being considered by the MEC, according to acting CEO of the Road Freight Association, Sharmini Naidoo. A further two audits are in progress, she told FTW. In terms of Sections 45-51 of the Road Traffic Act, it is the duty of the operator to ensure that all “reasonable measures” are taken to comply with the provisions for loading and transportation of goods prescribed by the Act. The operator is also liable if any offence in terms of the Act is committed by any manager, agent or employee of the operator.
