A CARGO claim against the owners of a ship which broke down off Durban last year has gone to London arbitration, according to John Dyason of Cape Town lawyers, Findlay & Tait.
Acting for the owners of the cargo of bagged rice on the MV Meghna, Findlay & Tait's first task was to get a court order allowing surveyors access to the ship and its documentation - a task complicated by the fact that the original owners had sold on the ship while it was still lying in Durban harbour.
But the parties eventually agreed to access - and a letter of undertaking was received from the owners after the ship's arrest.
The matter now rests with the London judiciary, Dyason added, and the case will be held subject to English law.
