Imminent Lapse of Anti- Dumping Duties In a Government Gazette dated 07 May 2010 a notice appeared in respect of the imminent lapse of anti-dumping duties for: (i) chicken meat portions originating in or imported from the United States of America (USA) – tariff subheading 0207.14; (ii) carbon black originating in or imported from Thailand – tariff heading 28.03; (iii) paperboard originating in or imported from South Korea (Korea) – tariff subheading 4810.92; and (iv) drawn glass and float glass originating in or imported from Indonesia – tariff subheading 7005.29. The application was lodged by the International Trade Administration Commission of South Africa (Itac). Manufacturers in the Sacu of any of the abovementioned products are required to submit substantiated information indicating that the expiry of the anti-dumping duty would likely lead to the continuation or recurrence of dumping and material injury. Comment is due by 30 June 2010. Rebate Items Created – Construction In a Government Gazette of 07 May 2010 a notice appeared in respect of Rebate Items (also known as “rebate provisions”) created for the importation of goods under rebate of the customs duty in terms of the Exchange of Letters between the Government of the Republic of South Africa and the Government of the People’s Republic of China for the construction of an Agricultural Technical Demonstration Centre. The Rebate Item is imposed with retrospective effect from 01 October 2009. Correction Notice – Harmonised System 2007 In a Government Gazette of 07 May 2010 a notice appeared on the substitution of tariff subheading 4805.10 with tariff subheading 4805.11, where it appears in Subheading Note 3 to Chapter 48 in the English version in Government Gazette of 15 December 2006, with retrospective effect from 01 January 2007. You will recall that the amendments of 01 January 2007 related to the World Customs Organisation (WCO) amendments to the Harmonised Commodity Description and Coding System i.e. the South African Harmonised Tariff Book, also known as the Tariff Book. The “Subheading Note” refers to a 6-digit tariff subheading. Rule Amendment – king Shaka International In the Government Gazette of 30 April 2010 a notice appeared in respect of the designation of King Shaka International Airport as an “Airport”. Trade Data Limitations – Sacu Tender The Southern African Customs Union (Sacu) published a Request for Tender (RFT) – Study to Assess the Trade Data Limitations Amongst Member StatesThe aim of this study is to assess and address intra- and extra-Sacu trade data limitations amongst member states in order to inform policy analysis and research in Sacu and also to assist the Sacu secretariat to house a reliable trade statistics database. The closing date for applications is 15:00 on 17 May 2010. Floating Hotels Customs Rules – Diarise Following the publication of a notice by the South African Revenue Service (Sars) in respect of the proposed amendments to the Rules to the Customs and Excise Act in respect of floating hotels for the duration of the 2010 Fifa World Cup, you can expect the amendment very shortly. This accounting for the fact the 2010 Fifa World Cup will commence on 11 June 2010. The Rules relate to “sealable goods”.
