Alan Peat SOUTH AFRICA’S long-awaited anti-dumping regulations were gazetted on November 14. Thus, for the first time since 1914 - when SA started with anti-dumping investigations Ð they are now backed by official statutes governing the technicalities of these actions. “A lot of time and effort has gone into drafting these regulations,” said PricewaterhouseCooper’s anti-dumping specialist, Francois Dubbelman. “We welcome that as a very positive step.” Indeed, the International Trade Administration Commission (Itac) appointed a private sector advocate to research and draft the regulations, he added. “Itac looks committed to the World Trade Organisation (WTO) regulations and the SA regulations are quite in line with the organisation’s anti-dumping agreement.” One of the most positive aspects of the new rules is that an anti-dumping action will now take no longer than 18-months to complete. “We can now conduct anti-dumping actions in a fair and transparent manner,” said Dubbelman.
