Wine exporter fined for non-payment

RAY SMUTS
A SPAT over wine destined for the European market has led to a Cape High Court order for a Villiersdorp exporter, Marynko Enterprises BK, to pay the Rooiberg Winery of Robertson more than R600 000.
In papers before court, Rooiberg asserted Marynko, trading as ML Wines, had not paid for wine ordered for the export market between June 2001 and April 2002.
Rooiberg had reached an agreement in 1991 that it would from time to time supply wine to ML Wines at cost. This would then be sold at a good profit to Dutch company Doorendael BV.
Judge Rosheni Allie rejected ML’s counter claim (for more than R500 000) that it could not make the sought profit due to Rooiberg’s failure to deliver the product in good time.
