Textile industry duty credit applications amended

New definition of manufacturer

THERE HAS been an amendment to the definition of a “manufacturer” in the International Trade Administration Commission (ITAC) guidelines for the Textile Clothing Industry Development Programme (TCIDP). According to information released to FTW by trade and customs consultants, Deloitte, the commission made this announcement on December 1. The previous wording defined manufacturer as a legal entity that has a manufacturing plant in the textile and clothing sector and has been in the business of manufacturing before 2005. “But,” said Deloitte, “the new definition will be used when processing duty credits for the export period April 1, 2006 to March 31, 2007. “And if a retailer is the holding company and owns the manufacturing company, the retailer may obtain or buy a certificate on behalf of the manufacturing company. But the certificate will be limited to the importation of raw materials such as yarn and fabrics.” Also, if the manufacturing company is an independent
legal entity registered as a manufacturer with the Registrar of Companies and has been operating before January 1, 2005, the manufacturing company may obtain or buy the certificate. But the certificate will be issued in the name of the manufacturing company only.
