Frozen Potato Chips – Provisional Payment / Anti-dumping Duties Lapse

On 20 June 2014 the provisional payment/anti-dumping duties imposed on 20 December 2013 on frozen potato chips or French fries originating in or imported from Belgium and produced by Clarebout Potatoes N.V; all other manufacturers excluding Clarebout Potatoes N.V.; and originating in or imported from the Netherlands, excluding that produced by Lamb Weston/Meijer V.O.F. lapsed.
This follows a similar event on 20 January 2014 when the provisional payment/safeguard duty on frozen potato chips lapsed. You will recall that two trade remedy investigations on frozen potato chips are being conducted simultaneously – a first for South Africa.
As a consequence, although provisional anti-dumping duties and a provisional safeguard were imposed on frozen potato chips when provisional determinations were made, these payments (duties) have now lapsed and as a result only the ordinary customs duty is applicable.
The final determination in respect of both investigations is now awaited.
