Possible Anti-dumping Terminations – Comment due

On 19 June 2015 the International Trade Administration Commission of South Africa (Itac) announced that in accordance with the provisions in Article 53.1 of Itac’s Anti -Dumping Regulations (ADR) any definitive anti-dumping duty shall be terminated on a date not later than five years from the date of imposition, unless the authorities determine, in a review initiated before that date on their own initiative or upon a duly substantiated request made by or on behalf of the domestic industry, that the expiry of the anti-dumping duty would be likely to lead to continuation or recurrence of dumping and material injury.

Itac has therefore notified all interested parties that, unless a duly substantiated request is made by or on behalf of the Sacu industry indicating that the expiry of the duty would be likely to lead to continuation or recurrence of dumping and material injury, the following anti-dumping duties will expire during 2016.

The goods in question, the country of origin or export, the rate of anti-dumping duty with the date of imposition and expiry of the anti-dumping duties in brackets are: (i) Blankets, People's Republic of China (China) 2 834c /kg [04 February 2011, 03 February 2016]; (ii) Blankets, Turkey 691 c/kg [04 February 2011, 03 February 2016]; (iii) Bolts and nuts of iron or steel, People's Republic of China (China) 55.4% - 122.7% [06 May 2011, 05 May 2016]; (iv) Polyethylene Terephthalate (PET), Chinese Taipei 75% [04 March 2011, 03 March 2016]; (v) PET, India 54.1% [04 March 2011, 03 March 2016]; (vi) PET, Republic of Korea 19.7% [04 March 2011, 03 March 2016]; and (vii) Unframed glass mirrors, India 68.74% [04 March 2011, 03 March 2016].

Manufacturers of the subject goods listed above in the Sacu who wish to submit a request for the anti-dumping duty to be reviewed prior to the expiry thereof are requested to do so within the time limit set out below. Where no replies are received from the Sacu manufacturers within these time limits, Itac will recommend the termination of the anti-dumping duties on the date of expiry.

Sacu manufacturers who do submit a request within the time limit set out above are requested to submit duly substantiated information injury to the Itac, on the dates as specified below indicating that the expiry of the duty would be likely to lead to continuation or recurrence of dumping and material injury:

(i) Blankets – 04 August 2015; (ii) Blankets – 04 August 2015; (iii) Bolts and nuts of iron or steel – 06 November 2015; (iv) PET – 04 September 2015; (v) PET – 04 September 2015; (vi) PET – 04 September 2015; and (vii) Unframed glass mirrors – 04 September 2015.

Manufacturers in the Sacu of the subject goods who wish to submit a request for the anti-dumping duty to be reviewed prior to the expiry thereof are requested to do so not later than close of business on 27 July 2015. Sacu manufacturers who do submit a request before 27 July 2015 should submit duly substantiated information to Itac indicating that the expiry of the anti-dumping duty would be likely to lead to continuation or recurrence of dumping and material injury.
