Transnet Port Terminals has declared force majeure at Durban Container Terminal Pier 1 following illegal industrial action in the form of a go-slow by employees on Monday. That's according to a notification from DCT terminal executive manager Hector Danisa, forwarded to FTW Online by Hariesh Manaadiar (shippingandfreightresource.com). "The situation is that the illegal industrial action has affected productivity and led to delays and backlog in the movement of cargo through the terminal," according to the notification. "Unfortunately this disturbance and its effects are beyond the control of TPT which has no option but to invoke the provisions of the force majeure clause in terms of TPT's commercial agreements. Any claims arising from this will therefore be dealt with as such in terms of the applicable contractual agreements," the notice states. "This constitutes an official notice suspending the provisions of all applicable contracts in the interim."
