Back-to-Back Trade Remedies for Potato Chips

On 08 August 2014 the International Trade Administration Commission of South Africa (Itac) announced the conclusion of the investigation into the alleged dumping of frozen potato chips, classifiable under tariff subheading 2004.10.20, originating in or imported from Belgium and The Netherlands.
On 25 July 2014 the South African Revenue Service (Sars) imposed a safeguard on frozen potato chips, which is due remain in force for a period of 2-years. In the anti-dumping investigation Itac recommended to the Minister of Trade and Industry that he impose definitive anti-dumping duties. The Minister decided to suspend the imposition of the anti-dumping duties until the termination of the safeguard duty on frozen potato chips.
We are not aware of a prior instance, domestic or international, of the application of back-to-back trade remedies.
